A: It is established that there is a dispensation for the fasting person to kiss and touch, provided it is less than intercourse; if he fears that his desire will be stirred and spread. It is established from Aisha (may Allah be pleased with her) that she said:Bulugh al-Maram 5:15 And it is established from 'Amr ibn Abi Salama (may Allah be pleased with them both), And a fatwa has been issued from us
in detail regarding the ruling on kissing and touching for the fasting person. The text of it is: (Whoever has desire and it is predominant in his mind that if he kisses his wife or touches her in a manner less than the private parts, he will ejaculate – it is forbidden for him to do so while fasting in Ramadan. And whoever has desire and it is not predominant in his mind that he will discharge, but he does not feel safe that it may happen to him – kissing and the like of the preliminaries of intercourse are disliked for him; and that is because completing his fast and preserving it is among the obligations, and touching his wife with a kiss and the like in a manner less than intercourse exposes him to invalidating his fast in these two cases, even if the degree of that and its invalidation of an obligatory fast differs – it is not permissible. As for whoever kissing and the like does not stir his desire; because he controls his urge, or because he is severely weak due to illness or old age – he may kiss his wife and touch her in a manner less than intercourse. And this is the case to which is attributed what is established from Aisha (may Allah be pleased with her) that she said:Bulugh al-Maram 5:15 Narrated by al-Bukhari and Muslim . For the Messenger of Allah (peace and blessings be upon him) controlled his desire and did not fear that it would lead him to intercourse and discharge, so kissing and the like of the preliminaries of intercourse were permissible, and it was permissible for those of his community who were in his position. And Abu Dawud narrated from Abu Hurayrah : Mishkat al-Masabih 2006 . In any case, if one does that and does not discharge, his fast is valid. And if he ejaculates, his fast is invalid and he must perform the full ritual bath and make up the fast.
