A340: The hadith is established from the Prophet (peace and blessings be upon him) that he used to kiss while fasting, and he used to have physical contact with his wives while fasting. The intended meaning of "kissing" is well known, and the intended meaning of "physical contact" is what is other than intercourse, which is touching without intercourse. As for intercourse, it invalidates fasting by explicit text and scholarly consensus. The intended meaning of "physical contact" here is contact that does not involve intercourse. The Prophet (peace and blessings be upon him) did this because he was in control of himself and knowledgeable about the rulings of his fasting, and what would affect it or invalidate it. As for other people, they should not proceed to do such things, such as proceeding to kiss or proceeding to have physical contact with a woman through touching or otherwise; because that is a cause for what invalidates the fast to occur from them, given their ignorance, weakness of faith, and lack of control over themselves. Therefore, it is best for the Muslim to avoid what arouses his desire and what he fears will invalidate his fasting; he should avoid these matters. As for the Prophet (peace and blessings be upon him), he did so because he controlled himself, and he was the most God-fearing and most reverent of people towards Allah, and he was most aware of what preserves his fasting. So, anyone other than the Messenger (peace and blessings be upon him) who is not secure in his own self should be cautious and stay away from these matters during fasting; because it may lead to the invalidation of his fasting.
