Q34: If I have debts, is it permissible for me to go for Hajj or
Umrah and leave them behind with the intention of paying them off after returning, and is it obligatory for me to buy the necessities of Hajj, such as the ihram garments, from my own wealth, or can I take them as a gift from a brother?
A34: First: The ability to perform Hajj is a condition for its obligation, so if a Muslim is able to do so, it is obligatory for him. As for the debtor, if he is able to pay off the debt along with the expenses of Hajj, and Hajj does not hinder him from paying it off, or if Hajj is done with the permission and consent of the creditor, who is aware of the debtor's situation, then his Hajj is permissible. Otherwise, the safest course for him is not to perform Hajj until he pays off the debt, but if he does perform Hajj, his Hajj is valid. Second: It is permissible for you to accept the gift in this case and in others, provided you do not know that it is from illicit earnings. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
