Fatwa number ( 20745 )
Q: My maternal uncle passed away at the age of about sixty-five, and he was
- may Allah have mercy on him - mentally impaired and unable to manage his affairs. My mother informed me that he was afflicted when he was about fifteen years old. As I understood from you previously, the mentally impaired person is exempt from the obligations of the Shari'ah, but is he exempt from Hajj ? Please issue a ruling, may Allah reward you, and I hope to receive your fatwa early so that if he owes a Hajj, I can take the initiative to perform Hajj on his behalf this year. And success is from Allah.
A: It is not obligatory for the insane person to perform Hajj or any other acts of worship; because the Prophet (peace and blessings be upon him) said:Jami` at-Tirmidhi 1423Hasan (Darussalam) and he mentioned among them the insane person until he regains his sanity, and as long as that is the case, do not perform Hajj on his behalf, and the insane person is the one who has lost his mind to the extent that he has become like a madman. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
