Q1: My uncle passed away and left a large estate. He had no children and had not performed the obligatory Hajj despite having the physical and financial ability. Are his brothers required to take a portion of the estate and have one of them perform Hajj on behalf of his brother, or not?
A1 : It is obligatory to take from the deceased's estate what is needed to perform Hajj on his behalf from the country in which he died, on the condition that the proxy has already performed Hajj for himself. It does not matter whether the proxy is a relative or not. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
