Q: My father intended to perform Hajj in a certain year, approximately 57 years ago. I was not yet of age at that time. A man learned of my father’s intention to perform Hajj and that I would go with him, so he said to him: “A woman has hired me with a crop to perform Hajj on her behalf. I know that you are going to perform Hajj and that your son is going with you, so I want you to allow your son to perform Hajj on behalf of that woman in my place.” My father said: “I cannot do that until we seek a scholarly ruling.” They then asked a person who was issuing fatwas in their time, and he ruled that it was permissible. Accordingly, an agreement was made between my father and that man for me to perform Hajj
on his behalf for that woman for “12 riyals.” He prepared me with some items, and I actually went with my father on foot. The Hajj was completed, and we took the money from the man. My question here is: What is the ruling on my Hajj performed on behalf of that woman? If it is established that it does not suffice, who is responsible, me and my father, or that man? I ask you to issue a ruling for me. May Allah grant you success, and peace be upon you. .
A : Your acting as a proxy for the aforementioned woman in Hajj before you reached the age of maturity does not suffice for her; because your Hajj on behalf of another is not valid before you have performed Hajj for yourself. This Hajj is considered to have been performed for you as a voluntary act due to your lack of maturity. It is obligatory for the man who took the crop from the woman to perform Hajj on her behalf, and you must return the money to him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
