Q: I have relatives who, when Ramadan comes, do not fast with us, on the grounds that one of their Shaykhs in Makkah did not order them to do so. They may delay fasting with us by a day or two. We have advised them, but they remain insistent on their state. Their argument is that their Shaykh did not order fasting, and the sighting of the crescent was not confirmed for them. My question to you, O honorable Shaykh: Is the sighting confirmed by the observation of one man, two men, or more? Second: O honorable Shaykh, what is the ruling on the fasting of these people? Then, should I maintain ties with them or boycott them? And what is the ruling on my dealing with them and maintaining ties with them? Please issue a ruling for us, may Allah reward you with good and may Allah benefit you with your knowledge.
A: The Prophet (peace and blessings be upon him) said:Musannaf Ibn Abi Shaybah 3:154 And in another narration: Sahih al-Bukhari 1909 , so it is obligatory to fast with the Muslims, and it is not permissible to lag behind them on the grounds that so-and-so
did not order fasting; because there is no obedience to a created being in disobedience to the Creator; because the Messenger (peace and blessings be upon him) ordered us to fast with the Muslims, and he (peace and blessings be upon him) said: And he (peace and blessings be upon him) said: Mishkat al-Masabih 173Isnād Da'īf (Zubair `Aliza'i) It is not a condition of fasting that everyone sees the crescent; rather, if one person sees it, it is obligatory for everyone to fast; because when Ibn 'Umar (may Allah be pleased with them both) informed the Prophet (peace and blessings be upon him) that he had seen the crescent, the Prophet (peace and blessings be upon him) ordered the people to fast. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
