The first and second questions from Fatwa No. ( 19600 )
Q1: An elderly woman who passed away ate during Ramadan for four years before her death due to her illness. Her intention for making up this period was to give a Hanbal (a woolen mat similar to a carpet) worth (3000 dinars) to the mosque. She also had several charities totaling approximately (4000 dinars), but we do not know her intention regarding them for the mosque. She passed away (may Allah have mercy on her) in 1993 CE. Is that amount sufficient for that, or do we, her family, take responsibility for making up the fasts? We want a detailed explanation of this.
A1: If the condition of this woman who broke her fast due to illness was that her illness continued until she passed away, or she recovered from it but was unable to make up what she missed due to a valid legal excuse, then she owes nothing, and neither do her heirs in terms of making up the fasts or feeding people; because in this case, she is not obligated to fast, so it is not required of her. However, if she recovered after her illness and was able to make up the fasts but was negligent and careless until she died without making them up, then it is prescribed for her relatives to fast on her behalf for the number of days she missed; based on what Aisha (may Allah be pleased with her) narrated, that the Messenger of Allah (peace and blessings be upon him) said:
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه

It is agreed upon as authentic. The intended meaning of "guardian" is a relative. If none of her relatives fast on her behalf, then feed on her behalf from her estate, one poor person for each day, half a sa' (a dry measure of about 3 kg) of the local staple food.
And this woman giving financial charities during her life, or her intention to give mats to the mosque, does not suffice for making up the fasts on her behalf, nor for the obligatory expiation of feeding if no one volunteers to fast on her behalf.
