Question:
The brother A. M. S. from Riyadh says in his question: If the fetus dies in the womb of its mother, is it obligatory for its father to slaughter an 'aqiqah on its behalf?
Answer:
The 'aqiqah is a confirmed recommended practice (sunnah) and not obligatory; two sheep for a male and one for a female. The sunnah is that it is slaughtered on the seventh day, even if it is born dead, and the sunnah is that it is also named and its head is shaved on the seventh day. If it is named on the first day, there is no harm; because the authentic hadiths were reported from the Prophet (peace and blessings be upon him) regarding this. It is established from him (peace and blessings be upon him) that he named his son Ibrahim on the day he was born, and he named Abdullah ibn Abi Talhah al-Ansari on the day he was born. And it is established from him (peace and blessings be upon him) from the hadith of Samurah ibn Jundub (may Allah be pleased with him) that he said:Sunan Abi Dawud 2838Sahih (Al-Albani). It was narrated by Imam Ahmad and the people of the four books of Sunan with a valid chain of narration.
And it is established from him (peace and blessings be upon him) from the hadith of Aishah and Umm Karz al-Ka'biyyah (may Allah be pleased with them both) that he (peace and blessings be upon him) ordered that two equivalent sheep be slaughtered as 'aqiqah for a boy, and one sheep for a girl. And it is established from him (peace and blessings be upon him) from the hadith of Amr ibn Shu'ayb from his father from his grandfather from the Prophet (peace and blessings be upon him) that he said:Sunan Abi Dawud 2842Hasan (Al-Albani) And these hadiths encompass the miscarried fetus and others, if the soul has been breathed into it, which is the one born in the fifth month and thereafter.
And what is prescribed is that it be washed, shrouded, and prayed over if it is born dead. And it is also prescribed that it be named and an 'aqiqah be slaughtered for it; due to the generality of the aforementioned hadiths. And Allah is the One who grants success.
