Q3: Is there an aqiqah for a miscarriage that is clearly a male or a female, or not? And likewise, if a child is born and then dies after a few days, and no aqiqah was performed for him during his life, is an aqiqah performed for him after his death or not? And if a month or two months, or half a year, or a year, or more has passed since the child’s birth and no aqiqah was performed for him, is an aqiqah performed for him or not?
Vol. 3: The majority of jurists hold that the 'aqiqah is a recommended practice (sunnah); based on what was narrated by Ahmad and al-Bukhari and the compilers of the Sunan from Salman ibn 'Amir from the Prophet (peace and blessings be upon him), who said:Sunan Ibn Majah 3164Sahih (Darussalam) , and what was narrated by al-Hasan from Samurah , that the Prophet (peace and blessings be upon him) said: Sunan Abi Dawud 2838Sahih (Al-Albani) , narrated by Ahmad and the compilers of the Sunan, and graded authentic by al-Tirmidhi , and what was narrated by 'Amr ibn Shu'ayb from his father from his grandfather, that the Prophet (peace and blessings be upon him) said: , narrated by Ahmad and Abu Dawud and al-Nasa'i with a good chain of transmission. There is no 'aqiqah for a miscarriage, even if it is determined to be male or female, if it is expelled before the soul is breathed into it; because it is not called a boy or a newborn. The 'aqiqah is slaughtered on the seventh day of birth. If the fetus is born alive and dies before the seventh day, it is recommended to perform the 'aqiqah for it on the seventh day and to give it a name. If the seventh day passes and the 'aqiqah is not performed, some jurists held that it is not recommended to perform it afterwards; because the Prophet (peace and blessings be upon him) specified the seventh day for it. The Hanbalis and a group of jurists held that it is recommended to perform it even after a month or a year, or more, from its birth; due to the generality of the established hadiths, and what al-Bayhaqi narrated from Anas (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) performed the 'aqiqah for himself after the Prophethood, and this is the more cautious course. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

من أحب منكم أن ينسك عن ولده فليفعل، عن الغلام شاتان مكافئتان، وعن الجارية شاة
