Q: I performed Hajj about ten years ago with my father, my mother, my brother, and my uncle. We encountered some matters about which we are in doubt. They are: We entered the state of ihram for Hajj and 'Umrah as a combined pilgrimage. When we arrived in Makkah , we performed the arrival tawaf and the sa'y of 'Umrah. Then we went to Mina and stayed there, which was the sixth day of Dhul-Hijjah. We remained in our state of ihram without exiting it until the morning of the Day of 'Arafah. We prayed Fajr in Mina , then we headed to 'Arafah , where we stayed until the sun set. Then we proceeded to Muzdalifah and prayed Maghrib and 'Isha'
there, combining them and shortening the prayer. Then we gathered the pebbles. Because our parents were with us, we continued walking after midnight to Mina , where we stoned the Jamarat al-Aqabah. Then we continued to Makkah , where we performed the tawaf of Ifadah and the sa'y. Then we returned for a second tawaf; the farewell tawaf. After that, we returned to Mina and stayed there for the first and second days. Then, after 'Asr, we left Mina for our country. Your Eminence: When we arrived in Mina , we asked some students of knowledge, and they answered us that the sacrificial animal (hady) was not obligatory for us. Also, regarding the permissibility of performing the farewell tawaf together with the tawaf of Ifadah, we were not satisfied with their statement. So we went to one of the lessons at Masjid al-Khaif in Mina , and we waited for the Shaykh until he finished, and we asked him: Is the sacrificial animal obligatory for us since we are performing a combined pilgrimage without exiting the state of ihram, and about the permissibility of the tawaf of Ifadah? He answered us with the same answer, which is that it is permissible, and that the best is tamattu' and the sacrificial animal. Our question is: Is our Hajj valid, and is the sacrificial animal waived for us, or is it necessary to offer it? If it is necessary, how do we do that? May Allah guide you and reward you with all good for us.
A: If the matter is as you described, it is obligatory for each of you to offer a sacrificial animal; because it is a combined Hajj where one slaughters in Makkah , and it is permissible for you to eat from it. And there is a fidyah (expiation) for leaving the farewell tawaf; because performing it before completing the acts of Hajj is not sufficient. Its proper place is after the end of the acts of Hajj and before departing from Makkah . The fidyah is a sheep that is acceptable as an 'Id sacrifice, slaughtered in Makkah and distributed to its poor. It is not permissible for you to eat from it. And whoever does not find one fasts
ten days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
