He says in his letter that he is asking about Hajj. He says: I performed the obligatory Hajj with a group in a private car via al-Madinah al-Munawwarah. At the time of entering the state of ihram, someone said to us to make the intention as follows: “O Allah, here I am responding to You for ‘Umrah.” This was on the sixth day of the month of Dhul-Hijjah.

The questioner : I performed the obligatory Hajj with a group in a private car via al-Madinah al-Munawwarah. At the time of entering the state of ihram, someone said to us to make the intention as follows: “O Allah, here I am responding to You for ‘Umrah.” This was on the sixth day of the month of Dhul-Hijjah. In this manner, when we arrived in Makkah al-Mukarramah, we performed tawaf around the House and sa’y between al-Safa and al-Marwah, we shortened our hair, and we exited the state of ihram. We remained not in the state of ihram until the morning of the eighth day, when we entered the state of ihram from Mina. Then we performed tawaf and sa’y, and we stayed overnight in Mina. We stood on Mount ‘Arafah and stayed overnight in Muzdalifah. On the morning of the Day of ‘Id, we went to the Ancient House and performed tawaf al-ifadah. Then we returned and stoned the Jamarat al-Aqabah and exited the state of ihram, but we did not slaughter a sacrificial animal. On the second and third days, we stoned the three pillars, but we did not slaughter a sacrificial animal. We performed tawaf al-wada’ and then left Makkah al-Mukarramah for Riyadh, as we are residents of Riyadh. The question here is: Is our Hajj permissible despite not slaughtering the hady, since after tawaf al-wada’ we traveled to Riyadh? In truth, he is asking a question, and upon reviewing his letter, several questions arise for us, which you have heard, such as the fact that they performed tawaf after entering the state of ihram from Mina before going to ‘Arafah, and matters of this kind?

The Shaykh : Yes.

The questioner : So what is the answer to this question...?

The Shaykh : Praise be to Allah, Lord of the worlds. As for the matter that occurred with them, their ‘Umrah is valid and there is no fault in it, because it was done in the prescribed manner. As for their Hajj, they entered the state of ihram from Mina, and there is no harm in entering the state of ihram from Mina.

The questioner : Yes.

The Shaykh : But they performed tawaf and sa’y, and we do not know what they intended by this tawaf and sa’y. If they intended it to be the tawaf of Hajj and the sa’y of Hajj, then they are not valid, even though it was mentioned in the case that they performed tawaf al-ifadah on the Day of ‘Id.

The questioner : Tawaf al-ifadah, yes.

The Shaykh : If they intended that this tawaf and sa’y were for Hajj, then they are not valid because they occurred at a time other than their proper time.

The questioner : Yes.

The Shaykh : Their proper time is after standing at ‘Arafah and Muzdalifah. Accordingly, they are considered null and void. Then, in the case, it is stated that they
performed tawaf al-ifadah but did not perform sa’y for Hajj. Therefore, sa’y remains upon them, and it is a pillar of the pillars of Hajj according to the stronger opinion among the scholars.

The questioner : Yes.

The Shaykh : Also remaining upon them is the hady, the hady of tamattu’, for they did not slaughter it. It is obligatory to slaughter it on the Day of ‘Id or on the days of Tashreeq, and in Makkah in the Haram.

The questioner : Yes.

The Shaykh : Accordingly, they now need to complete the Hajj by returning to Makkah and performing sa’y between al-Safa and al-Marwah, as well as slaughtering the obligatory hady. Whoever among them is able to do so should slaughter it, and whoever is not able should fast for ten days.

The questioner : Yes.

The Shaykh : Then, after sa’y, they perform tawaf al-wada’ and return to their home.

The questioner : Yes.

The Shaykh : Yes.

The questioner : In truth, they say that they relied on the book *Al-Tahqiq wa al-Iydhah li Kathir min Masail al-Hajj wa al-‘Umrah wa al-Ziyarah ‘ala Dhaw’ al-Kitab wa al-Sunnah* by Shaykh ‘Abd al-‘Aziz ibn Baz, and they mentioned some pages. But in truth, if they had relied on Allah the Mighty and Majestic and then on this book, they would have been successful in performing Hajj. But they did not understand it. They say that we also relied on a Syrian Shaykh whom we met, and he dictated this statement to us.

The Shaykh : In any case, it appears that if they had the book *Al-Tahqiq wa al-Iydhah* with them, they did not understand it.

The questioner : Yes, yes.

The Shaykh : If they had understood it, their actions would have been in accordance with the truth, if Allah wills.

The questioner : Yes.
