Q: Last Ramadan, I was ill in the military hospital in Riyadh . I was struck by pain and was hospitalized on the evening of Friday, 29/8, in the heart center. It was decided to perform surgery on three arteries, and the doctors advised me not to fast because it would affect my health condition, as I suffer from high blood pressure, diabetes, and asthma, as is clear from the attached medical reports. For these reasons, I was prevented from fasting this obligatory duty. In the month of Muharram 1420 AH, I was struck by an illness in the chest and liver, as a result of which I was hospitalized in the military hospital. After examination, I was given intensive (antibiotic) treatment and the doctors advised me of the necessity of taking it daily, averaging three times a day, for a period of approximately nine months, starting from 12/2/1420 AH. O His Eminence the Mufti: I am about seventy years old, and I am confused about my situation regarding making up the days of the blessed month of Ramadan 1419 AH. Therefore,
I seek your Eminence's fatwa on the issue of making up the fasts.

A: If you are unable to make up the fasts on a permanent basis, then it is obligatory for you to feed a poor person for each day with a quantity of one and a half kilograms, which you give to a poor person for the number of days, and fasting is not obligatory upon you; because of the saying of Allah the Exalted:
And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor personوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ
[Al-Baqarah 2:184]
. This verse abrogated the ruling for the one who is able; because of His saying the Exalted:
So whoever sights [the new moon of] the month, let him fast itفَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ
[Al-Baqarah 2:185]
. And what remained from it is the ruling for the one who is unable to fast due to old age or an illness that is not expected to end. And if you hope that the illness will end and you can make up what is upon you, then you break your fast and wait until you are able to make it up, and then you make it up; because of the saying of Allah the Exalted:
and whoever is ill or on a journey - then an equal number of other daysوَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ
[Al-Baqarah 2:185]
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
