Q: I performed Hajj with my mother, who is sixty-five years old, as a tamattu' pilgrim. By the grace of Allah (Glorified and Exalted is He), the Hajj was facilitated, and praise be to Allah. After completing the tawaf al-ifadah, I heard people saying: "Sa'y is not obligatory" . So I asked a shaykh wearing a thobe and a shemagh, and carrying a radio in his hand. I felt reassured about him when I saw the people, i.e., the pilgrims, asking him. I approached him and asked: "Do I have to perform sa'y?" He said: "Tamattu'?" I said: "Yes." He said: "You do not have to perform sa'y." I did not perform sa'y because I was convinced by this man's words. Therefore, I would like you to issue a fatwa on my case, informing you that my mother is advanced in age and does not have the ability to perform Hajj again due to her old age and poor health condition. May Allah preserve you for providing guidance to every Muslim in matters of their religion, and peace be upon you.
A : You and your mother must go to Makkah to perform the aforementioned sa'y. If she is unable, she should perform it while being carried or in a cart; because this opinion is the correct one, and it is the view of the majority of scholars, and the authentic Sunnah indicates this through the actions of the Companions of the Prophet (peace and blessings be upon him), who performed tamattu' by his order (peace and blessings be upon him). If you had intercourse with your wife after Hajj, you must slaughter in Makkah a sacrificial animal that is sufficient as an udhiyah for the poor there. If your mother has a husband who had intercourse with her, then she is also obligated to pay the aforementioned expiation.
