Fatwa No. ( 14552 )
Q: I went to perform the obligatory Hajj with my daughter. Since I have performed Hajj more than once, but my daughter is performing it for the first time, and we intended to perform Hajj from the miqat, we arrived in Makkah al-Mukarramah and performed tawaf and sa'y. Then we headed to Mina and from there to the Mount of 'Arafah , and we stood at 'Arafah . On the Day of 'Id, we stoned the Jamarat al-'Aqabah and headed to Makkah and performed tawaf al-ifadah. Then we returned to Mina and stayed there overnight. On the second day, we stoned the three jamarat, and returned to Mina . On the third day, we stoned the first jamarah, but we were caught in a crowd, and both my daughter and I fainted. We were taken to the hospital, where we stayed for four hours. I recovered from the unconsciousness, and I was greatly affected by what happened to me. Then we took a car and headed to our country in this region. We appointed a person to stone the remaining three jamarat on our behalf, but we did not perform tawaf al-wada'. Therefore, we would like to inform you and hope you will advise us about what is required of us regarding our delegation for stoning the Jamarat al-'Aqabah, and regarding tawaf al-wada'. May Allah protect you.
A : If the matter is as you described, that you experienced hardship, then your delegation of the aforementioned person to stone on your behalf is valid. As for leaving tawaf al-wada', it is obligatory for each of you to pay a fidyah for leaving the tawaf; it is a sheep that is sufficient as an udhiyah in Makkah and is distributed to the poor of the Haram. If he does not find one, he fasts for ten days.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
