The tenth question of Fatwa No. ( 1734 )
Q10: There are people on the day of the festival or the second day of the festival who appoint proxies to stone the pillars on their behalf, and they travel to their countries. Is their Hajj considered complete, or is it not?
A10: Allah the Exalted commanded in His Noble Book to complete the Hajj
and the 'Umrah by saying:[Al-Baqarah 2:196] , and their completion is not achieved except by being sincere to Allah in them and following the Messenger of Allah (peace and blessings be upon him) in them. Therefore, it is not permissible for a Muslim who has entered the state of ihram for Hajj or 'Umrah to neglect any of their acts, or to commit any of the prohibited matters that diminish them. Whoever appoints a proxy to stone the pillars on the days of Tashriq or on one of the days of Tashriq and departs on the Day of Sacrifice is considered mistaken and heedless of the rites of Allah. And whoever appoints a proxy to stone the pillars on the eleventh or twelfth day of the days of Tashriq and performs the Farewell Tawaf to hasten his travel has contradicted the guidance of the Messenger of Allah (peace and blessings be upon him) and what He commanded regarding the performance of the rituals and their order. He must repent and seek forgiveness for that, and it is obligatory for the one who did that to offer a sacrificial animal for leaving the overnight stay in Mina, a sacrificial animal for leaving the stoning of the pillars for which he appointed a proxy and departed, and a third sacrificial animal for the Farewell Tawaf, even if he performed Tawaf around the House when leaving; because his Tawaf occurred at a time other than its proper time; because the Farewell Tawaf is only to be performed after the completion of stoning the pillars. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
