A2: It is obligatory for one who intends Makkah for Hajj or 'Umrah, while being outside the spatial miqats, to enter the state of ihram from the recognized miqat for him if he passes it or is opposite it, if it is not on his route or if he is in an airplane; based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats:
They are for them, and for whoever comes to them from among those who are not their relatives, from those who intend Hajj or 'Umrah. And whoever is below that, his place of ihram is from where he begins.هن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج أو العمرة ومن كان دون ذلك فمهله من حيث أنشأ
The hadith. Accordingly, it is obligatory for you to pay a fidyah for leaving an obligatory act of Hajj while forgetful, and you did not return when you remembered that you had forgotten the ihram.
It is made up with blood, which is slaughtering a sheep, or one-seventh of a cow, or one-seventh of a camel, to be slaughtered in Makkah and distributed to the poor of the Haram . Forming the intention the night before to perform 'Umrah from the time of preparing for the journey and continuing the travel is not sufficient for this; rather, it is necessary to have the intention to enter the ritual at the time of passing the recognized miqat or being opposite it, if you are in an airplane or if the miqat is not on your route. The ihram for Hajj or 'Umrah is not established except by this. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
