Q: My wife and I went to Makkah al-Mukarramah intending to perform 'Umrah, but my wife was wearing a niqab on her face. She knew that the burqu' was prohibited for tawaf, but she did not know whether the niqab was permissible or not? Please give us a ruling, may Allah reward you with good.
A : If the situation is as described, and she knew that it is not permissible for her to wear the burqu' during her ihram for 'Umrah, then it is obligatory for her to pay an expiation, which is slaughtering a sheep, or feeding six poor people, or fasting for three days, along with repentance to Allah for committing what the Messenger of Allah (peace and blessings be upon him) forbade for a woman in her state of ihram, by his saying:
The woman in ihram does not wear the niqab and does not wear glovesلا تنتقب المرأة ولا تلبس القفازين
. It was narrated by al-Bukhari in (Sahih al-Bukhari) and by Imam Ahmad in (Musnad, vol. 6, p. 119). It is forbidden for a woman to wear the burqu' or the niqab during her ihram for 'Umrah or Hajj before the first tahallul. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
