Fatwa number ( 15881 )
Q: During Hajj, on the day of 'Arafah , we were renting a car,
The important thing is that on the same day, the day of 'Arafah , we left the driver and he went. Maghrib came, and we were supposed to descend from 'Arafah to Muzdalifah , but we waited for this driver and he did not come until 2:00 AM, and he still did not come. Finally, we rented another car so that we could catch the overnight stay at Muzdalifah , even if only for an hour. However, due to the traffic congestion and the halt in traffic, Allah decreed that we would not be able to catch the overnight stay at Muzdalifah , as we arrived at approximately 8:00 AM. In other words, we took about 6 hours for this short distance. And of course, we had many small children with us who would not be able to walk, and we would not be able to carry them. What is the ruling in this case? And if a fidyah is required of us, does it have to be paid in Makkah , or is it possible to pay it through Al-Rajhi Bank from our location in Najran? Please issue a ruling for us; may Allah reward you.

A : For the one who is unable to reach Muzdalifah to stay the night there due to the delay of the means of transport, and he is unable to walk because of his weakness or because he has a family that he must stay with—such a person is excused for leaving the stay and no blood (sacrifice) is required of him; based on the saying of Allah the Exalted:
Allah does not charge a soul except [with that within] its capacityلاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَا
[Al-Baqarah 2:286]
and His saying the Glorious:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
, and Allah knows best.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
