Q: A number of questioners from the residents of 'Ar'ar came to us regarding mistakes they made when they went to perform the obligatory Hajj this year. They left from 'Arafah after Maghrib and did not pass through Muzdalifah nor stand there, but rather
they went directly to the large Jamarat al-'Aqabah and stoned it, then headed to the Sacred House and performed the Tawaf al-Ifadah and Sa'y. This was before midnight, and some of them noticed that the Haram was empty of people. A woman and her son asked one of the mosque imams near the Haram , and he issued a ruling that she had to return, stay overnight at Muzdalifah , stone the large Jamarat al-'Aqabah at its proper time, and then perform the Tawaf al-Ifadah. The woman informed her son and those with them, but they did not respond. So the woman returned to Muzdalifah , stayed overnight there, and performed her Hajj as it should be. We hope you will issue a ruling to the questioners regarding what they did, which was not staying overnight at Muzdalifah , and stoning the Jamarat al-'Aqabah, performing the Tawaf al-Ifadah, and Sa'y before midnight.
A : It is obligatory for those who left the overnight stay at Muzdalifah without an excuse and stoned the Jamarat al-'Aqabah before midnight—it is obligatory for each of them to pay two expiations: an expiation for leaving the overnight stay at Muzdalifah without an excuse, and an expiation for stoning before half the night. As for the Tawaf al-Ifadah before midnight, it must be repeated by the pilgrim returning to Makkah at any time and performing the Tawaf al-Ifadah, and the sooner he does it, the better. Whoever had sexual intercourse before repeating the Tawaf is required to pay an expiation, which is: a sacrificial animal that is acceptable for the 'Id sacrifice, slaughtered in Makkah and distributed to its poor, along with repentance to Allah the Exalted for that.
