The questioner : He says: I have performed the obligatory Hajj, and a fidyah became obligatory upon me due to some errors in the rites of Hajj, and due to a lack of money, I was unable to slaughter the fidyah during the Hajj. Is it permissible for me to pay the fidyah in my country and feed the poor there, or what should I do?

The Shaykh : This is not permissible, because the blood of Tamattu' and Qiran must be in the Haram, in Makkah or in Mina or within the miles of the Haram. And if you had nothing at that time, then the obligatory thing, as Allah the Mighty and Majestic commanded, is to fast three days during the Hajj and seven when you return to your family. Yes.

The questioner : It appears that this slaughter is a blood of compensation (dam jibrān) because he says it is due to some errors in the rites of Hajj?

The Shaykh : If it is a blood of compensation.

The questioner : Yes.

The Shaykh : Then we must know what this thing was that happened. If it was leaving an obligatory act, then there is a fidyah which he slaughters in Makkah because it is related to the rite. And if it was...

The questioner : And it is not sufficient in other than Makkah?

The Shaykh : Yes?

The questioner : And it is not sufficient in other than Makkah?

The Shaykh : And it is not sufficient in other than Makkah.

The questioner : Yes.

The Shaykh : And if he committed a prohibited act, then as we mentioned previously, one of three things is sufficient for it: either feeding six poor people, and this is in Makkah or in the place where the prohibited act was committed, or fasting three days, and in this case he fasts three days because he is not in Makkah.

The questioner : Yes.

The Shaykh : Except if this prohibited act was intercourse before the first tahallul in the Hajj, then the obligatory thing is a large camel or cow (badanah) which he slaughters in the place where the prohibited act was committed or in Makkah and distributes it to the poor. Or if it is the penalty for hunting, then the obligatory thing is its equivalent, or feeding, or fasting. If it is fasting, then it is in his place. And if it is feeding or slaughtering, then Allah says:
as an offering [to Allah] delivered to the Ka'bah هَدْيًا بَالِغَ الْكَعْبَةِ
[Al-Ma'idah 5:95]
So it must be there in the Haram.

The questioner : Yes, and he may appoint someone for that, for example, a resident in Makkah if he knows someone resident in Makkah?

The Shaykh : Yes, he may appoint someone for this.

The questioner : Yes.

The Shaykh : Because the Prophet (peace and blessings be upon him) appointed 'Ali (may Allah be pleased with him) to slaughter what remained of his hady.

The questioner : This is a message from the listener Musa Saleh from the Eastern Region.
