Q2: I have five orphans, and I have one hundred thousand riyals belonging to them. I used this money to purchase equipment and batteries to develop their assets. However, weeks pass and I do not sell any of this equipment, and on some days I sell to them for three hundred to five hundred riyals. Is it obligatory for the orphans to pay zakah on the value of the equipment, and is it permissible to spend their zakah on them?
A2: It is obligatory for you to pay zakah on the funds of the orphans for which you are the agent, and which you have prepared for sale, whenever a lunar year has passed over them; because, given the situation you described in the question, they are considered merchandise for trade. Likewise, it is obligatory for you to pay zakah on the cash you hold for them whenever a lunar year has passed over it. It is not permissible to give them from the zakah of their own funds. May Allah absolve you of your responsibility and guide everyone to all that is good.
