Q: I traveled from Ha'il to Jeddah , and I intended to perform 'Umrah and entered the state of ihram. I had arranged to meet my wife at Jeddah Airport , where she had arrived from Cairo . I took her from Jeddah to Makkah , and we entered the room before performing the 'Umrah. I had intercourse with her, and we did not perform the 'Umrah. I did not know that I was required to pay an expiation. After three years, I asked the imam of a mosque, and he said: "You must sacrifice an animal." Please issue a fatwa on what is obligatory for me? May Allah reward you with good.
A: If the situation is as described, then your 'Umrah, in which you had intercourse with your wife before exiting the state of ihram, is invalid. It is now obligatory for each of you to enter the state of ihram from the miqat from which you entered ihram for that invalid 'Umrah, and to perform a new 'Umrah to make up for the invalid one. It is also obligatory for each of you to slaughter a sheep that is acceptable as a sacrificial animal for 'Id al-Adha
in Makkah and distribute it to the poor of the sacred precinct. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
