Q: I went to Makkah al-Mukarramah this year in Ramadan with the intention of performing 'Umrah, accompanied by my wife. We traveled from Abha while she was menstruating. When we reached the miqat of Yemen , she found that her menstruation had ended, so she entered the state of ihram with the intention of 'Umrah. When we reached the Haram , she found that the bleeding had returned, so she did not perform the rites of 'Umrah.
We went up to the city of Jeddah . When she became pure, we had intercourse several times. Then, after 'Id al-Fitr, we went to Makkah , and she performed the 'Umrah as a make-up for the first one. What is obligatory upon her?
A: The intercourse that occurred between you invalidated your wife's 'Umrah. She was required to continue with it until she completed it, and she has completed it as you mentioned. She must enter the state of ihram for 'Umrah a second time from the miqat from which she entered ihram for the first 'Umrah, as a make-up for the invalid 'Umrah, and perform its rites, including tawaf, sa'y, and shortening the hair. She must also slaughter a sheep in Makkah and distribute it to the poor of the Haram as a fidyah (ransom payment) for the intercourse. Both of you must repent to Allah (Glorified and Exalted is He) for the intercourse that occurred before exiting the state of ihram from the 'Umrah.
