The ruling on one who exits the state of ihram before completing 'Umrah due to fatigue
Machine translationRead the Arabic original
A man performed 'Umrah eight years ago. During the tawaf, he felt severe fatigue and exhaustion and was unable to complete the 'Umrah. He exited the state of ihram, put on his regular clothes, and left Makkah. Does he owe anything?
Eight years ago, glory be to Allah! Eight years ago, and he did not ask about his religion. If he had lost a lame sheep, he would have gone out at night to look for it, yet he did not ask about this religion until eight years later. Look at this negligence! According to the opinion of some scholars, this man is obligated to put on the clothes of ihram now and go to Makkah to complete his 'Umrah. He must perform tawaf, sa'y, and shorten his hair. If he had engaged in sexual intercourse during this period, his 'Umrah is invalid, and he must complete it, then perform a new 'Umrah to make up for the invalid one. If he married after canceling the 'Umrah, his marriage contract is defective. He must avoid his wife and renew the contract after he completes the 'Umrah. What I am saying now is the school of Imam Ahmad ibn Hanbal according to his followers.
There is another opinion that if a person is unable to complete the rites due to illness—not fatigue, because fatigue can be resolved by resting and completing the rites—He exits the state of ihram, but he must offer a sacrificial animal, as Allah the Exalted said: [al-Baqarah:196] Here is a point of difficulty: does he exit the state of ihram before slaughtering the sacrificial animal or not?If we say: He does not exit the state of ihram; this is the first problem I mentioned. And if we say: He exits the state of ihram; the matter is easier. All he has to do is slaughter a fidyah. So ask the man: did this fatigue lead to an illness such that he could not complete the 'Umrah even if he rested, or not? If he can, it means he is still in his 'Umrah. He should go directly, but the prohibitions he committed do not harm him according to the stronger position because he was ignorant. However, regarding the marriage, he must renew the contract during this period.
Summary: We see that if this fatigue led to an illness that prevents him from completing the 'Umrah, then he only has to offer the sacrificial animal. Otherwise, he is still in the state of ihram now. He must go in the state of ihram from his country or from his house now and complete the 'Umrah. He owes nothing for the prohibitions he committed because he was ignorant. If he contracted a marriage during this period, he must avoid his wife until he completes the 'Umrah and contracts a new marriage.
