Q1: A man and his wife set out for Hajj, and the man was performing tamattu' while the woman was not performing tamattu'. The man had intercourse with his wife while she was in the state of ihram. What is the ruling of the Shari'ah in this matter?
A1: If this man had intercourse with his wife during his state of tahallul between 'Umrah and Hajj, meaning that he had finished the acts of 'Umrah and had not entered the state of ihram for Hajj, then he owes nothing. As for the woman, if his intercourse with her was before her sa'y for 'Umrah, then her 'Umrah is invalid, and she owes a sacrificial animal and must make up the 'Umrah from the miqat from which she entered the state of ihram, preferably. However, if that was after the tawaf and sa'y but before the shortening of the hair, then the 'Umrah is valid, and she owes for that either feeding six poor people, or slaughtering a sheep, or fasting for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
