Q1, 2: A man went to perform 'Umrah, and for many past years he would go from Riyadh to al-Tan'im Mosque and enter the state of ihram from there, and he had performed 'Umrah more than once in this manner . He also had with him those who did as he did: "his wife, whom Allah took, his wife's mother, his father, and his sons." And after he would go from Riyadh to al-Tan'im and enter ihram for the first 'Umrah, then complete his 'Umrah, then return a second time to al-Tan'im Mosque and enter ihram to perform another 'Umrah for some of the people whom Allah took, what is required of him? Please inform us, may Allah reward you. And a man came to Jeddah intending to go to Riyadh , then the next day he went to Makkah and entered ihram from al-Tan'im Mosque , then returned to Jeddah to travel to Riyadh . What is required of him, may Allah reward you?
Vol. 2 : It is obligatory for anyone who intends to perform Hajj or 'Umrah, whose location is outside the spatial miqats, to enter the state of ihram for both from the miqat he passes through if it is on his route, or from the one he passes by if it is not on his route, or if he is in an airplane. It is forbidden for him to pass the miqat designated for him without entering ihram; based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats:
on his way or passing by it if it is not on his way, or if he is in an airplane, it is forbidden for him to pass the recognized miqat without entering the state of ihram; because the Prophet (peace and blessings be upon him) said when he designated the miqats: This hadith is agreed upon by al-Bukhari and Muslim. It was obligatory for this person and those with him to enter the state of ihram for 'Umrah from Qarn al-Manazil , which is now called al-Sayl al-Kabir ; because that is their miqat. Therefore, their entering the state of ihram for 'Umrah from al-Tan'im is an error; because they passed the miqat without entering the state of ihram. Their 'Umrah is valid for them, but it is obligatory for each one of them to offer a sacrificial animal for every 'Umrah he performed by passing the miqat while intending 'Umrah, then entering the state of ihram from al-Tan'im , because they left an obligatory act of 'Umrah, which is not entering the state of ihram from the miqat. Leaving an obligatory act is compensated with a sacrificial animal, so a sheep that is valid as an 'Id sacrifice, or one-seventh of a camel, or one-seventh of a cow, is slaughtered in Makkah and distributed to the poor of the Haram . If he is alive, he pays it out; if he is dead, it is paid out of his estate if he has wealth. If he has no wealth, it is prescribed for one of his children or relatives to slaughter the sacrificial animal that was required of him, and he will have the reward if Allah wills; because that is in the ruling of a debt upon the deceased. As for the 'Umrah that this person initiated from Makkah , and he entered the state of ihram for it from al-Tan'im , he owes nothing for that, and he has done what is prescribed for him; because
who is in Makkah, whether he is a resident there or came to it without intending Hajj or 'Umrah, then later decides to perform 'Umrah, he enters ihram from the nearest part of al-Hal, and at-Tan'im is the nearest part of al-Hal to al-Haram . Likewise, anyone who comes to Jeddah from Riyadh or elsewhere without intending Hajj or 'Umrah, then later decides to perform Hajj or 'Umrah, his miqat is Jeddah , so he enters ihram from there. His leaving the ihram from there and entering ihram from at-Tan'im obligates him to offer a sacrificial animal, as mentioned earlier at the beginning of the question; because he left an obligatory act. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
