The Doubt Concerning Pilgrimage Funds

Machine translationRead the Arabic original
Q2: I am a Saudi citizen working in the Civil Police under the General Security Directorate. One night, some of my colleagues and I were on patrol and we found
some smugglers of qat trees, and with them were some donkeys, may Allah reward you, loaded with qat. We seized the animals with their loads and handed them over to the competent authorities responsible for this matter. Those authorities, in turn, burned the qat and returned the donkeys to us, authorizing us to sell them openly in the market. We sold these animals and divided their prices among ourselves. My father had passed away before performing the obligatory Hajj, so I funded my father’s Hajj from my personal funds, but there was a shortfall of approximately 600 riyals. I covered this amount from the value of the animals we sold. My question is: 1 – What is your esteemed opinion regarding this Hajj? 2 – If you have any observations, what do you advise us to do? May Allah reward you with good.

A2 : If the giving of the donkeys to you was by way of a reward, then there is no harm in performing Hajj with that money on behalf of your father; because taking the donkeys from their owners is a form of discretionary punishment (ta’zir) against them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
