Q: As you know, may Allah reward you, regarding the high number of car accidents and the deaths resulting from them, where the driver may be granted safety while some of the passengers pass away. The driver is then imprisoned until the blood money (diyah) for the deceased is secured at the Sharia court in that country. Collecting the diyah, or diyahs, can take a long time, resulting in the driver remaining in prison for an extended period. In light of this, our tribe has decided to establish a special fund limited to car accidents that occur by divine decree and destiny. The amount in this fund is collected from every individual in the tribe who is capable of driving a car, holds an independent driving license, and is capable of earning a living. Each of these individuals pays only one thousand riyals, which is deposited with a specific trustee for this fund. In the event of an accident, God forbid, the driver's guardians go to the fund's trustee and borrow the required diyah from him. They pay it to the competent authority, thereby releasing the imprisoned driver. Afterward, the driver begins to collect the diyah from the 'aqilah (kin group) as prescribed by the Shari'ah. Upon collecting the diyah, he repays the amount his guardians borrowed from the fund, and that amount remains as the capital of the fund. Since the fund was not established
A commercial purpose and does not engage in any type of trade with its capital, and its balance is fixed, increasing or decreasing only by the entry of new members or the exit of members. The question is: Is zakah obligatory on this fund? Knowing that each thousand riyals of the fund's capital belongs to an independent individual. I ask you to please answer, given the importance of this matter, and it would be desirable if the question were restated in the answer to ensure satisfaction, if Allah wills. And peace be upon you.

A: Whoever intends to return his contribution must pay zakah on the thousand riyals every year until he takes it from the fund or it is forgiven. Whoever does not intend to return it owes no zakah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
