Fatwa number ( 17755 )
Q: I have a mother who is advanced in age, understands nothing of the world, and does not know anyone. I am her son, her legal agent, and her guardian over her and my siblings, by a bequest from my father (may Allah have mercy on him). I keep a sum of money for her. Is zakah due on this money? If it is obligatory, and when paying the zakah: 1- Is it obligatory to pay the zakah in cash? 2- Is it permissible to buy fabrics and distribute them from this zakah? 3- Is it permissible to give to the sons of her daughters from this zakah? Knowing that they are all employed.
4- Is it permissible to give to her daughters from this zakah? Knowing that each of her daughters owns a building. I ask you, your Excellency, to inform me on these points and guide me to the right path
A : It is obligatory for you to pay zakah on your mother’s money, for whom you are the guardian, and to pay the zakah in coins. It is permissible to buy clothes with it and distribute them to the poor if that is better for them. It is not permissible to spend this woman’s zakah on her children or her children’s children; because zakah is not permissible from the ancestor to the descendant, nor the reverse. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
