Q1: Since my grandmother is advanced in age, having reached over eighty years old, and because she has become unable to manage all her religious and worldly affairs properly, my father, in agreement with my uncles—her sons—deemed it best for them to open her safe, in which she keeps her money and other belongings. This was done with the intention of assessing that money to pay its zakah, if it had reached the nisab, which has not been paid for several years. In fact, they opened the safe and found a considerable amount, exceeding twenty thousand riyals. The problem they now face is: how should the zakah of this money be paid? Especially since several years have passed and its zakah has not been paid. We hope for guidance on the correct method for paying the zakah of this money.
A1 : It is obligatory to refer the matter to the court to appoint one of your grandmother’s sons as her agent over her money. After the agency is established, he must pay the zakah for each year when it is completed. As for the past years, he must investigate their number and act according to his predominant opinion, in consultation with his other brothers, and pay the zakah for the years in which it is most likely that the zakah was not paid. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
