Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency the Minister of Finance and National Economy, acting in his capacity, in his letter No. (9 / 2 / 6315), which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with No. (3131) and dated 27 / 5 / 1421 AH. His Excellency asked a question, the text of which is as follows: “Peace be upon you, and Allah’s mercy and blessings. In follow-up to our letter No. (9 / 2 / 1948) dated 13 / 2 / 1421 AH, which included a request for
information regarding the ruling on the permissibility of the tribal shaykhs and their deputies in the Southern Region and part of the Western Region taking a tenth of the zakah . Since our aforementioned letter previously indicated this Ministry’s opinion that these shaykhs and their deputies are not considered among those working in the collection of zakah, and since this Ministry receives transactions from the Asir Region’s Emirate and Finance Department, including requests to disburse the dues for the tenth (‘ushr) for a number of shaykhs and deputies who were unable to disburse their dues through the zakah collectors, and given that no response has been received to date, we hope that Your Eminence will provide information on the ruling regarding the permissibility of their taking this tenth, so that the necessary measures can be taken accordingly. After the Committee’s study of the inquiry, it responded that if the tribal shaykhs and their deputies no longer have any work in the collection of zakah, then they are not entitled to any of it; because they previously took it in exchange for their work, as they were considered among those working on it, and their work has ended. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
