Q: What is the ruling of the Shari'ah regarding wailing over graves, and is it permissible to spend from zakah funds on wailing over them , so that we may be clear about our religion and so that we do not fall into error, especially since we receive many requests asking for assistance in wailing over graves, justifying the request for wailing over them by saying it is out of fear of the encroachment of construction upon them and the erasure of their landmarks, and thus their seizure by those of weak character. May Allah reward you with good and place that in your scales of good deeds on the Day of Resurrection.
A: Wailing over graves is a matter required by the Shari'ah; for the sake of preserving them from desecration and harm to the dead by walking over them, but it is not permissible
to wail over them from zakah funds; because zakah is restricted to the eight categories mentioned in the saying of Allah the Exalted:
Zakah expenditures are only for the poorإِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ
[At-Tawbah 9:60]
... the verse, so it is obligatory to restrict oneself to these categories and not to other charitable projects, such as building mosques and wailing over graves and the like, and rather these projects are established from donation funds or the competent authority such as the Ministry of Municipal Affairs and the like spends on them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
