Q: His father passed away, and he had bequeathed a third of his estate for a sacrifice for himself and his parents. There is now a surplus from the yield after the sacrifice is paid. He asks about the surplus: should he offer another sacrifice for him, or should the remainder be divided among the heirs?
A: If the matter is as the questioner described regarding his father’s bequest and the existence of a surplus from the yield, then if the questioner is the executor of his father’s bequest, and if there is no valid textual evidence in the bequest specifying that the surplus from the yield be distributed to specific parties or individuals, he should spend the surplus on acts of righteousness, such as contributing to the construction and furnishing of mosques, and giving charity to the poor and needy. If there are needy relatives who are entitled to charity, they are more deserving of the surplus from the yield. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
