Q: I hope you will inform me about a woman who bequeathed one-third of her wealth to her nephew, on the condition that he perform the sacrifice. The woman passed away, and her one-third was placed in a house. The house is rented out, and there is a surplus remaining after the sacrifice. Is the surplus permissible for the agent to take? Do her two brothers, or the one who is present, have any right to the surplus? And is it permissible for the agent to reside in the house in exchange for the sacrifice and other obligations that are due from him?
A : After the Committee studied the inquiry and the attached will, it issues the ruling
that the work should be carried out as the testatrix mentioned in her will. The remainder of the house's income should be set aside each year for the repair of the house if it needs repair. The rest is to be spent on acts of charity at the discretion of the agent. If the testatrix has poor relatives, he should give charity to them from it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
