Praise be to Allah alone, and may prayers and peace be upon the one after whom there is no prophet. Having reviewed the matter referred to His Eminence the Grand Mufti by His Excellency the Minister of Islamic Affairs, Endowments, and Guidance, in his letter No. (4/5/2272) dated 6/9/1431 AH, which was based on a letter from a member of the teaching staff at the College of Teachers in al-Ras , formerly Salih ibn Muhammad ibn Khalid al-Rashid , and forwarded to the Committee by the General Secretariat of the Council of Senior Scholars with number (1212) and date 8/9/1431 AH, it was stated in His Excellency’s letter: “Attached to this is the letter received from Salih ibn Muhammad al-Rashid , a member of the teaching staff at the College of Teachers in al-Ras , formerly, containing an inquiry about the ruling on the presence of toilets inside the sacred precinct of the mosque , and the passage of sewage pipes through the sacred precinct of the mosque. I hope you will review the documents attached to this letter and kindly clarify the Shari'ah ruling on this matter.”
After studying the inquiry, the Committee responded as follows: First: It is obligatory that planning take into account not constructing toilets inside the mosque
or passing their drainage pipes through its courtyard. As for any sewage pipes already present in the ground of the mosque, there is no harm in them as long as they are sealed and nothing comes out of them. Second: There is no objection to building restrooms within a wall that encloses them and the mosque’s courtyard, whether the door opens onto the courtyard or onto the outside of the mosque. The Committee recommends that the restrooms be built in a location that does not cause harm to the worshippers and visitors of the mosque, so that the benefit is realized and the harm is averted.
