Q1: Regarding the rulings on miscarriage, we have read the fatwa of the two Shaykhs, Ibn Uthaymeen and Ibn Baz, (may Allah have mercy on them), that if the creation of a human being becomes apparent in the fetus, or if its age exceeds (81) days, it is considered postpartum bleeding (nifas); otherwise, it is
irregular bleeding (istihadah). With the developments in medical technology, and through ultrasound (X-rays), it has been shown that the fetus has the creation of a human being and its age is (9) weeks (approximately 63 days). What is the ruling in this case?

A1: The pregnancy that results in the termination of the waiting period ('iddah) and the classification of the blood discharged from the woman as postpartum bleeding (nifas) is that in which the image of a human being is apparent, whether it has completed eighty days or not. This is because if something of the creation of a human being becomes apparent in it, it is known to be a pregnancy, and it falls under the saying of Allah the Exalted:
And for those who are pregnant, their term is until they give birthوَأُولاَتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[At-Talaq 65:4]
. The ruling is the same if she expels a lump of flesh in which the creation is not apparent, but trustworthy midwives or doctors testify that it contains a hidden image by which it is known to be the creation of a human being.

A2: As long as no trace of the image of a human being is seen in what fell from the woman or was removed from the uterus
during the cleaning procedure, but rather it is only pieces of flesh in which nothing is seen indicating that it is the image of a human being, then no rulings of pregnancy apply to what fell, and the blood discharged is blood of corruption (fasad), not postpartum bleeding (nifas). Therefore, the woman prays and fasts while it is present. However, if the discharge of blood continues, she performs ablution (wudu') for each prayer after its time has entered. If it lasts more than a month, the woman observes her usual custom.

Q3: There are cases of missed pregnancy where the fetus may be more than 3-4 months old, but by ultrasound its age is less, for example two months, or it is just a gestational sac without a fetus. What is the ruling?
A3: As long as the image of a human being does not appear in the pregnancy in question when it is delivered, it is not considered a pregnancy to which the rulings of pregnancy apply.
