All praise is due to Allah alone, and may blessings and peace be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency the Director of the Armed Forces Hospital in Riyadh and al-Kharj . His Excellency requested a review of the attached medical report concerning the wife of (S. H.), which states that she is in her fifth month of pregnancy, that the fetus is deformed, and that continuing the pregnancy poses a danger to the mother. The report reads as follows: The wife of Mr. (S. H.) is in her fifth pregnancy, and she is currently 140 days pregnant. After ultrasound imaging was performed, it was found that the child has a congenital deformity, as the child has no skull, and there is no
brain tissue (absence of formation of the skull and brain). Please clarify the Shari'ah position on the possibility of inducing early delivery, as it is impossible for the child to survive after birth, and there are no surgical operations that can be performed on the child to save his life. It is also noted that if the pregnancy continues until the end of the ninth month, delivery may be difficult, and there is a high likelihood of having to perform surgical operations to remove the child from the womb, which includes a danger to the mother's life
After the Committee studied the inquiry, it responded : If the situation is as described, such that continuing this woman's pregnancy until delivery results in a threat to the mother's life, then there is no harm in aborting the pregnancy before it is complete, in order to protect the mother's life and avert harm from her. However, if the abortion is for the sake of the deformity alone, then it is not permissible to terminate it. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
