Q: Some political circles have succeeded in Switzerland in convincing the government to issue legislation banning the construction of minarets, and they are now trying to ban the hijab in public schools. To that end, they are exploiting a statement made by some Muslims: “That the hijab is a cultural tradition, not one of the obligations and duties of the religion.”
The question is: Is it permissible for a girl or a mature young woman to remove her hijab in Switzerland in light of the circumstances you mentioned?
A: It is obligatory for the Muslim woman to adhere to the hijab whenever she appears before non-mahram men, whether in the lands of Islam or elsewhere. The hijab is a legal ruling and an obligatory duty from the duties and obligations of the religion. Evidence for this is the saying of Allah the Exalted:
O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments. That is more suitable that they will be known and not be abused
يَا أَيُّهَا النَّبِيُّ قُلْ لأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلابِيبِهِنَّ ذَلِكَ أَدْنَى أَنْ يُعْرَفْنَ فَلا يُؤْذَيْنَnot expose their adornment except that which [necessarily] appears thereof and to wrap [a portion of] their headcovers over their chests
وَلا يُبْدِينَ زِينَتَهُنَّ إِلا مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّO Messenger of Allah, one of us may not have an outer garment. He said (peace and blessings be upon him): Let her sister wear part of her outer garment.
يا رسول الله: إن إحدانا لا يكون لها جلباب، فقال صلى الله عليه وسلم: لتلبسها أختها من جلبابها
