Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable Shaykh Turki ibn 'Abd al-'Aziz Al-Shaykh, the judge of the Ta'if Sub-Section Court, with number (2516) and date 25/3/1429 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (559) and date 6/4/1429 AH. His Excellency requested the Committee to consider the inquiry submitted by the residents of the village of ( Sar al-Jadhar ) south of Ta'if . The text of the question is: (A small mosque was established in our village more than fifteen years ago, and it was recently replaced, praise be to Allah, by a congregational mosque in another location in the village, while the old mosque remains as it is. We request clarification of the
Shari'ah position regarding establishing a women's center for memorizing the Qur'an in the location of the old mosque, as there is no objection from the one who previously donated this land to that, especially since the mosque has become abandoned and dilapidated). The honorable Shaykh Turki ibn 'Abd al-'Aziz Al-Shaykh, the judge of the Ta'if Sub-Section Court, stated that he visited the site and found the matter as described, and that the old mosque is only about one hundred meters away from the new one. A letter was written to His Excellency the Minister of Islamic Affairs, Endowments, and Guidance with number (2525) and date 13/4/1429 AH, to review and provide information on the actual situation and the Ministry's opinion on the matter. Then, a response came from His Excellency in his letter number (4/5/3043) and date 3/12/1429 AH, which stated: that the mosque is old, dilapidated, and not being utilized, and the Ministry sees the benefit of using the mosque's land to build a women's house for memorizing the Qur'an, as there is now a new mosque in the village

Based on this, the Permanent Committee for Scholarly Research and Ifta has issued a ruling that it is permissible to build a women's house for memorizing the Qur'an on the land of the old mosque in the village of ( Sar al-Jadhar ) south of the province of Ta'if , which has become abandoned due to its dilapidation, and is no longer needed or utilized after the construction of another mosque nearby. The land of the old mosque and the women's house to be built on it
for memorizing the Qur'an shall remain as an endowment, subordinate to the new mosque.
