Question:
A message was received by the program from the listener: Rami Shafiq Abd al-Nasir. He says in one of his questions: I wake up late in the morning on some days, and there are only six or seven minutes left until the sunrise. I perform wudu. Should I begin with the obligatory prayer, or with the Sunnah of Fajr? Because I fear that if I pray the Sunnah, the sun will rise, and the time for the obligatory prayer will be missed?

Answer:
It is obligatory for you to set the clock for the time of Fajr a little before it, so that you wake up before the adhan, prepare for the prayer, and pray with the Muslims in congregation. It is not permissible for you to delay until the time for the congregation is missed, or the time itself is missed. This is forbidden, an evil, and it is imitating the enemies of Allah, the hypocrites.
Rather, it is obligatory for every Muslim to take care of praying in congregation in Fajr and other times, and to seek help from Allah, then from the clock. The clock is beneficial. If one does not have someone to wake him up, or fears that they might be negligent, he should buy a clock and place it by his head, and set it for near the adhan; so that he wakes up with the adhan, and is able to perform wudu and ghusl if he has a wife, and be present with the Muslims in the mosques to pray in congregation. This is what is obligatory for the Muslim, and it is not permissible for him to be late in this or to be lax in this. Being lax in this is imitating the hypocrites, about whom Allah the Exalted said:
Indeed, the hypocrites [think to] deceive Allah, but He is deceiving them. And when they stand for prayer, they stand lazilyإِنَّ الْمُنَافِقِينَ يُخَادِعُونَ اللَّهَ وَهُوَ خَادِعُهُمْ وَإِذَا قَامُوا إِلَى الصَّلاةِ قَامُوا كُسَالَى
[Surat al-Nisa: 142]. Then he proceeds to the mosque and prays with the people.
And if he missed the prayer, he begins with the regular Sunnah, praying two light rak'ahs, the regular Sunnah, then he prays the obligatory prayer. The Prophet (peace and blessings be upon him) used to pray them even if the time was missed. Perhaps he would sleep through the prayer on some of his journeys (peace and blessings be upon him), and they would not wake up until the sun was high. When he got up, he ordered the adhan to be called, and he prayed the regular Sunnah, and he prayed Fajr, peace and blessings be upon him.
So if a believer is overcome by sleep and does not get up until late, he prays the Sunnah of Fajr, then he prays the obligatory prayer, even if Fajr has risen, even if the sun has risen, even after the sun has risen. The Sunnah is to precede it before the prayer, even at the time of the sunrise. But it is never permissible for him to delay getting up for the prayer until he misses the congregational prayer. Rather, it is obligatory, and it is incumbent upon him to do the things that make him wake up so that he attends the prayer with the Muslims at their times, in Fajr and in other times. May Allah grant everyone guidance.
