Q5: If a woman is menstruating and fears that if she enters the state of ihram for 'Umrah, she will be detained with her family, so she does not intend to perform 'Umrah because she does not know if she will be able to leave her family before they depart from Makkah, and she becomes pure and wants to perform 'Umrah, from where does she enter the state of ihram? From the miqat boundaries or from the nearest point outside the sacred precinct?
A5: If a person intends to enter the state of ihram for 'Umrah while in Makkah, it is obligatory for him to go out to the non-sacred area (al-Hal) and enter the state of ihram from there. This is because the Prophet (peace and blessings be upon him) ordered 'A'ishah (may Allah be pleased with her), when she wanted to perform 'Umrah while in Makkah, to go out with her brother to al-Tan'īm and enter the state of ihram from there. And if a person intends to perform 'Umrah while outside the sacred precinct, he enters the state of ihram from the place where he made his intention.
