Q3: My brother broke his fast for a few days last Ramadan (approximately five days) and passed away without making them up. My question, Your Eminence: What is the ruling in this case, and should the fast be made up on his behalf?
A3: If his illness was one from which recovery was not expected, then he should only be fed on his behalf, and he should not be fasted for. If he recovered from his illness but was unable to make up the fasts due to a valid legal excuse, then he owes nothing, neither feeding nor fasting. If he was able to make up the fasts but did not do so without an excuse, then it is prescribed to fast on his behalf.
