The third question of Fatwa No. ( 18611 )
Q3 - I have read in the books of Islamic jurisprudence that sleeping in the position of one who is firmly seated does not invalidate the ablution, which is when the buttocks are firmly resting on the ground. As for sleeping in any other position, that is what invalidates the ablution. We have also heard that sleeping in general invalidates the ablution. We seek a sufficient answer.
A 3: The correct opinion among the scholars is that sleep which removes sensation invalidates the ablution, whether the person is standing, sitting, or lying down. As for sleep while sensation remains, it does not invalidate the ablution. According to this opinion, the hadiths reported in this chapter are reconciled, including the hadith of Safwan ibn 'Asal (may Allah be pleased with him):
That the Prophet (peace and blessings be upon him) ordered them, when they were traveling, to wipe over the leather socks for three days and nights, except in the case of major ritual impurity, but in the case of passing wind, urination, and sleepأن النبي صلى الله عليه وسلم أمرهم إذا كانوا مسافرين أن يمسحوا على الخفين ثلاثة أيام ولياليهن إلا من جنابة، ولكن من غائط وبول ونوم
. Thus, the Prophet (peace and blessings be upon him) equated sleep with passing wind and urination, without specifying details. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
