Q: I inform your Eminence that I have a wife who used to suffer during her pregnancy. During the sixth month, she was discharged, and the fetus did not complete its development. She was approximately in her fifth month. This was about five or six years ago at the military hospital in the city of Riyadh . She had two miscarriages at the same military hospital in Riyadh , one in the fifth month and the other in the fourth month. My question is: When my wife miscarried at the hospital, their procedure is to bury it in the hospital. When they placed the fetus in a jar, they told me: Do you want to take it, or do you want to sign this paper and let the hospital handle its procedures and burial? After that, I signed the paper for them to handle all the procedures in the Islamic manner. Is what I did valid or not? And after all this, I did not name the fetus that was miscarried. Is it permissible to name it now, after approximately six years have passed? Please inform me, may Allah reward you with good. And is there any sin on me?
A: There is nothing wrong with authorizing the hospital to perform the necessary washing, shrouding, prayer, and burial. It is recommended for you to perform the 'aqiqah sacrifice for it and name it, even after the period mentioned in the question has passed, whether it was a male or a female. May Allah make it an intercessor and a source of intercession, and may He replace it for you with something better.
