Q: A young woman from Yemen says: I went with my brother’s wife to the hospital, and she was suffering from bleeding for two days. She was four months pregnant. When she entered the hospital, the doctor decided to admit her because she was very tired. She asked me to accompany her to the restroom. When we entered the restroom, the fetus fell directly from her belly into the drain, and she fell to the ground in a state of unconsciousness. I was shocked, confused, and terrified, and I did not know what to do. So I rushed to the water valve and opened it until the fetus fell into the drain. I took my brother’s wife and returned her to the bed she was sleeping on. By Allah, I do not know if it was alive or dead, but I believe it came out dead. I told my father, my brother, and my family about this incident, and they did not say anything to me. However, I feel intense regret and remorse for what I did. What must I do, and what is the expiation I must perform for this incident? I am in anxiety and confusion. Please issue a ruling and guide us. May Allah reward you with the best reward.
A: If the miscarriage did not complete the fourth month, then no
religious rulings are established regarding it upon its falling. However, if it had been taken, wrapped in a cloth, and buried, that would have been better. And as long as none of that occurred, nothing is established regarding its neglect. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
