Q: I present to your Eminence this issue, which concerns my mother from about thirty years ago, and it is: 1 - She was pregnant in her eighth month and carried something heavy, so the next day the child was born dead . 2 - She became pregnant a second time, and in her eighth month she suffered from a throat illness, so she went to the doctor and he gave her a gargle medicine and told her: do not swallow it. She did not pay attention to his words and swallowed it, so she felt the fetus moving in her belly, and the next day the girl was born dead. 3 - And she became pregnant a third time, so when she reached the fifth month she carried something heavy and the child was born dead. 4 - And she became pregnant a fourth time without knowing that she was pregnant, so she had severe chest tightness, so she went to the doctor and he gave her medicine which she drank
and the fetus was aborted. Please give us a ruling, may Allah reward you and may Allah reward you with all good.
A: Your mother owes an expiation for accidental killing for the first, second, and third times, which is: freeing a believing slave for every pregnancy she caused to be aborted. If she cannot find one, it is obligatory for her to fast two consecutive months for every time she caused an abortion. As for the fourth time, nothing is required of her; because the fetus had not yet formed, as the soul had not yet been breathed into it. There is no harm in her fasting two months, then resting for a period, then fasting two more months, then resting for a period, then fasting the final two months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
