The seventh question of Fatwa number ( 20308 )
Q 7: We pray four rak'ahs for Jumu'ah. Is this what we do in the five daily prayers?
A 7: Praying four rak'ahs for Jumu'ah contradicts the Sunnah of the Prophet (peace and blessings be upon him), the practice of the Rightly Guided Caliphs, and the consensus of the scholars. Numerous hadiths have been transmitted from the Messenger of Allah (peace and blessings be upon him) that he used to pray Jumu'ah in two rak'ahs and deliver two sermons before it. More than one scholar has reported the consensus of the scholars that the Jumu'ah prayer is two rak'ahs, with the imam delivering two sermons before it. The scholars in every school of jurisprudence have clarified that Jumu'ah and the festivals are prayed behind a just imam or an open sinner, and it is not a condition for the imamate in these prayers that the imam be infallible. No one among the people is infallible except the Messenger of Allah (peace and blessings be upon him) and the prophets before him. Jumu'ah was prayed in the time of the Messenger of Allah (peace and blessings be upon him) in a village of the Abd al-Qays in Bahrain , called ( Jawatha ), just as it was prayed in the major cities and villages in the time of the Rightly Guided Caliphs, including Ali (may Allah be pleased with him), and in the time of the People of the House after him , such as al-Hasan and al-Husayn and Ali ibn al-Husayn and Muhammad
ibn Ali al-Baqir and Ja'far ibn Muhammad al-Sadiq , and others of the renowned imams of the People of the House, known for their knowledge, virtue, and uprightness (may Allah be pleased with them). None of them objected to praying Jumu'ah in two rak'ahs, nor did they object to the two sermons before it, nor did they stipulate that the imam be infallible or just. They prayed behind the rulers in Makkah and al-Madinah and al-Sham and Iraq , among whom were the just and others, yet they did not object to this. It is not recorded that any of them repeated the prayer behind the imams of their time from among the Muslims, even if their justice was not well-known, or even if their open sinfulness was known, such as al-Hajjaj and his like, who did not possess the attributes of justice. Thus, it becomes clear that the truth with which Allah sent our Prophet Muhammad (peace and blessings be upon him), and upon which his Companions (may Allah be pleased with them) followed after him, including Ali and his sons (may Allah be pleased with them all), is that the Jumu'ah prayer is two rak'ahs, that there are two sermons before it, and that it is performed in the major cities and villages. As for the inhabitants of the desert and women, Jumu'ah is not obligatory upon them; rather, they pray Zuhr in four rak'ahs, unless they are travelers. In that case, it is prescribed for them to pray the traveler's prayer in two rak'ahs, or to pray Jumu'ah with the people in the major cities and villages, as it suffices for them in place of Zuhr. Likewise, the traveler is not required to pray Jumu'ah, but if he prays Jumu'ah with the residents, it suffices for him in place of Zuhr. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
