Q: My father is an elderly man who suffered from insanity, which confined him to bed for a long period of more than three years. This resulted in a disturbance of his intellect and a paralysis of his tongue, preventing him from speaking, which led to his abandoning prayer and fasting. The illness continued with him until he passed away. My question is: Are we, his children, required to make up the fasting he missed, given that several Ramadans passed and he did not fast a single day from any of them? Therefore, we ask your Eminence to inform us of what is required of us, and may Allah preserve you?
A: If your father was devoid of intellect, then there is no prayer or fasting required of him, because intellect is a condition for legal accountability. Nothing is required of you on his behalf. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
