Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother R. 'A. F., may Allah guide him to all good, amen.
Peace be upon you, and Allah’s mercy and blessings, and after that:
Your letter dated 4/9/1393 AH has been received, may Allah guide you. It contained the information that your mother fell ill, her consciousness became impaired, and she did not fast for seven Ramadans, and no charity was given on her behalf. Then she recovered from her illness, and she is able to fast the aforementioned Ramadans. Your question is: Is it permissible for her son to fast on her behalf for what she missed? Or should she fast them herself, even if it occurs to her in the future, because her illness is a nervous condition? Or is it permissible to give charity on her behalf? It was known.
Answer: If she left off fasting due to the impairment of her consciousness, then she owes no making up of the fasts; because the Shari'ah obligations were lifted from her during the period in which she lost consciousness; due to the saying of the Prophet (peace and blessings be upon him):Jami` at-Tirmidhi 1423Hasan (Darussalam) and he mentioned among them the insane person until he regains his senses. Whoever has an impaired consciousness due to any type of illness is in the ruling of the insane person, with no obligation upon him. However, if she left off fasting due to illness while her mind was sound, then she must make up the fasts after recovering from her illness according to her ability, even if done separately. If she died in her illness, it is not made up on her behalf, and it is not permissible for anyone to fast on her behalf while she is alive. May Allah guide everyone to understanding in His religion and steadfastness upon it, and may He reward you with good for your concern for her matter, and peace be upon you and the mercy of Allah and His blessings.
